Privacy Policy

1. Who We Are

Patio (“we,” “us,” or “our”) is a software-as-a-service platform for real estate agents and brokerages, operated by John Nguyen as a sole proprietor in Waco, Texas. Our platform is accessible at runpatio.com.

This Privacy Policy describes how we collect, use, store, share, and protect your personal information, and explains your rights under applicable law — including the Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code § 541 et seq.

2. Information We Collect

Account Information

Name, email address, phone number, brokerage name, real estate license number, and account credentials (passwords are stored in hashed form — we never see your plain-text password).

Professional and Business Data

Commission and transaction records, deal pipeline information, continuing education (CE) certificates, vendor and expense records, and content you create using our tools.

Contact Data

Names, email addresses, phone numbers, and other information about your clients and prospects that you upload or enter into our CRM. You are solely responsible for ensuring you have the legal right to share your contacts' information with us and to authorize calls to them on your behalf.

Payment Information

Billing name and address. Payment card details are collected and processed directly by Stripe, Inc. Patio does not store, log, or have access to your raw credit card numbers.

Call and Communication Data

When our Jessica AI assistant places calls on your behalf, those calls may be recorded. Call recordings, transcripts, and metadata (date, time, duration, phone numbers) are stored on our platform. Callers are informed at the start of each Jessica AI call that the call may be recorded.

Usage and Technical Data

Features you access, pages you visit, IP address, browser type, and error logs.

3. How We Use Your Information

• Provide and operate the Patio platform
• Run Jessica AI calling on your behalf using consent you have obtained
• Generate and publish social media content
• Process payments through Stripe
• Send trial notifications, billing receipts, and platform announcements
• Comply with legal obligations
• Detect fraud and unauthorized access
• Improve the platform through usage analysis

We do not sell your information to third parties or use it for targeted advertising outside of Patio.

4. Automated Calling Disclosure (TCPA)

By enabling Jessica AI calling for any contact, you represent and warrant that you have obtained prior express written consent from that individual to receive automated telephone calls from your brokerage, that you maintain records of that consent, and that you will immediately honor any opt-out requests.

Patio automatically enforces call time windows: no calls before 8:00 AM or after 9:00 PM local time of the recipient based on their area code.

5. How We Share Your Information

We do not sell your personal information. We share it only with:

6. Data Retention

• Account and contact data: duration of account + 2 years
• Call recordings: 90 days
• Call transcripts: 1 year
• Financial records: 7 years (legal requirement)
• Deleted account data: purged within 30 days of deletion request

7. Your Rights (Texas TDPSA)

If you are a Texas resident, you have the right to:

• Know what personal information we hold about you
• Correct inaccurate information
• Delete your personal information
• Data portability — receive your data in a portable format
• Opt out of sale of your data (we do not sell data)

8. Data Security

We implement row-level security on all database tables, encrypted connections (TLS), hashed passwords, 8-hour session timeouts, role-based access controls, and real-time error monitoring. In the event of a data breach, we will notify affected individuals and the Texas Attorney General within 60 days as required by law.

9. Children's Privacy

Patio is not directed at anyone under 18. We do not knowingly collect information from minors. Contact us immediately if you believe a minor has provided us with data.

10. Changes to This Policy

We will notify you of material changes by email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
