Terms of Service

1. Agreement to Terms

By creating an account or using any part of the Patio platform, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

These Terms are a binding agreement between you and John Nguyen d/b/a Patio (“Patio,” “we,” “us”).

2. Free Trial

New users receive a 14-day free trial. A valid payment method is required to start.

If you do not cancel before the end of your trial, your card will be automatically charged on day 15 at the monthly rate for your selected plan.

We will send you emails on Day 1, Day 7, and Day 13. The Day 13 email will explicitly disclose that your card will be charged the next day unless you cancel.

Trial cancellations before day 14: no charge.

3. Billing and Cancellation

Subscriptions auto-renew monthly or annually. Upgrades are immediate and prorated. Downgrades take effect at the next billing cycle.

Cancellations take effect at the end of the current billing period. You retain access until your paid period ends.

No refunds are issued for partial months, unused features, or plan downgrades. Trial cancellations before day 14 are not charged.

4. Automated Calling — TCPA Compliance

Patio's Jessica AI places outbound calls to your contacts on your behalf. You are solely responsible for TCPA compliance.

By enabling Jessica for any contact, you represent and warrant that:

• You have obtained prior express written consent from that individual to receive automated calls from your brokerage
• That consent was obtained before Jessica contacts them
• You maintain records of that consent
• The number is not on the National Do Not Call Registry, or you have proper consent
• You will immediately honor all opt-out requests

Patio enforces call time windows: no calls before 8:00 AM or after 9:00 PM local time of the recipient. Calls may be recorded; callers are notified.

You agree to indemnify Patio for any TCPA violations arising from your use of Jessica AI.

5. Acceptable Use

You agree not to use Patio to:

• Violate any applicable law or TREC rules
• Call individuals without TCPA-compliant consent
• Upload content you don't have rights to use
• Attempt to reverse-engineer or circumvent security features
• Resell access without written permission
• Harass or harm any individual

6. Your Data

You own your data. You grant Patio a limited license to process it solely to provide the Service. Upon cancellation, your data is retained 30 days then permanently deleted. Export your data before canceling.

7. TREC Compliance

Patio is a technology tool — not a real estate brokerage or legal service. You remain solely responsible for compliance with TREC, your brokerage's policies, and all applicable real estate licensing laws.

8. Disclaimers

The service is provided “as is.” To the fullest extent permitted by law, Patio disclaims all warranties. We do not warrant that the service will be error-free or that AI-generated content will be accurate. You are responsible for reviewing AI-generated content before publishing.

9. Limitation of Liability

To the maximum extent permitted by law, Patio is not liable for indirect, incidental, or consequential damages. Our total liability is limited to fees you paid in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by Texas law. Disputes shall be resolved in the state or federal courts of McLennan County, Texas. Before filing any claim, you agree to email john@runpatio.com and give us 30 days to resolve the matter informally.

11. Changes to Terms

We will notify you by email at least 30 days before material changes take effect. Continued use after the effective date constitutes acceptance.
